LWAY路达社会责任行为准则V1.0
本行为准则(以下简称“行为准则”)适用于路达公司内部及所有向路达公司提供货物和服务的供应商/分包商、次级供应商(以下统称“供应商”)。本行为准则传达并阐明了路达公司内部及所有供应商与路达进行业务往来时必须遵守的基本要求。路达保留更改本行为准则中要求的权利,并希望在此情况下供应商接受此类更改。
This Lota Social Responsibility Code of Conduct (hereafter referred as Code of Conduct) is applicable to Lota and to any supplier/sub-contractor, sub-supplier that provides goods and services to Lota (hereafter referred as suppliers). The Code of Conduct states the basic requirements which Lota and its supplier shall comply during business activities. Lota reserves the right to revise the requirements in this Code of Conduct and expects the supplier to accept such changes.
  • 1、遵守法律法规:必须完全遵守所有适用的国家和/或地方法律、法规,包括但不限于与劳工、健康安全、消防安全、环境相关的法律法规。
    Legal compliance: Lota and suppliers shall act in full compliance with all applicable national and local laws (including but not limited to labor, health and safety, fire protection and environment related laws).
  • 2、童工与未成年工:不雇用童工。最低工作年龄不得低于16周岁,即中国的最低就业年龄或完成义务教育的最低年龄。鼓励合理使用未成年工(16-18周岁)。
    Child Labor and young workers: No child labor. Minimum legal age for employment is 16, which is the minimum working age in China or the minimum age to complete compulsory education. Proper use of young workers (16-18 years old) is encouraged.
  • 3、强迫和强制劳动:不得使用任何类型的强制性的、抵押的、契约的、贩卖的、奴役或监狱劳工。所有工作应是自愿的,并且在合理通知的前提下,所有员工必须拥有离职或终止雇佣关系的自由。不得要求员工交“押金”或政府颁发的身份证明文件。
    Force and compulsory labor: No compulsory, bonded, indentured, trafficked, slave or prison labor. All work must be voluntary and workers shall be free to leave work or terminate their employment with reasonable notice. Workers shall not be required to pay a deposit or surrender any government-issued identification.
  • 4、商业道德:必须严格遵守路达反腐败反贿赂政策,不伪造与路达业务行为相关的文件、记录。
    Business ethics: Lota and suppliers shall strictly comply with Lota’s policy of anti-corruption and anti-bribery. Documents and records related to Lota business are not manipulated.
  • 5、环境保护:应遵守国家和地方的环境法律法规,包括废气排放、固废处理、废水排放、噪声排放、规范使用化学品、水资源节约利用以及危险和有毒物品相关的所有法律法规。
    Environment protection: Lota and suppliers shall act in accordance with national and local environmental laws and regulations, including laws and regulations related to exhaust emission, solid waste treatment, wastewater discharge, noise emission, normative use of chemicals, water conservation, hazardous and toxic substance.
  • 6、健康安全与消防安全:应为所有员工提供安全、健康的工作环境及居住设施(若适用)。应做好预防措施,对员工展开工作场所健康安全和消防安全的培训,免费提供适当的个人防护设施,防止工作场所伤害。
    Health and safety, fire protection: Workers are to be provided with safe and healthy working environment and accommodations (if applicable). Lota and suppliers shall take appropriate precautions and provide workers with the training of health and safety, fire protection in workplace. To prevent injuries in workplace, appropriate personal protective equipment shall be provided to workers for free.
  • 7、工时与薪酬:必须遵守国家关于工作时间和社保福利的法律规定。应向所有员工支付符合或超过地方法律和法规规定的最低工资、加班补贴、福利及保险。鼓励向员工提供满足其基本需求的工资和福利,向员工及其家庭提供可自由支配的收入。应给所有员工缴交工伤保险。
    Working hours and wages: Lota and its suppliers shall act in compliance with national laws about working hours and social security. Workers should be paid wages which are not less than the legal minimum, overtime compensation, benefits and insurance. It’s encouraged to provide workers with wages and benefits which can meet their basic needs, and incomes at their disposal. Lota and suppliers shall provide accident insurance to all workers.
  • 8、结社自由:应尊重所有员工合法地选择或拒绝参加团体的自由,只要此类团体被法律允许。不应非法干涉、妨碍或阻止员工参加正当、合法的员工结社和相关活动。
    Freedom of association: Lota and suppliers respect the workers’ right to join or not join an association, as far as the association is permitted by law. Lota and supplier shall not illegally intervene, hinder or prevent workers to join the legal association and participate in relevant activities.
  • 9、骚扰和惩戒:必须尊重员工并给予员工其应有的尊严。所有员工都不应受到体罚或者身体上的、性别的、心理上或者言语上的骚扰和侮辱。不得参与、支持或允许体罚、暴力恐吓或其它形式的精神和身体强迫,且不得使用任何公开的警告和惩罚系统。应建立申诉渠道,并为申诉人员保密。
    Harassment and disciplinary: Lota and supplier shall treat workers with respect and dignity. Workers shall not be suffered corporal punishment, or any physical, gender, mental, verbal harassment and insult. Lota and suppliers shall not engage in, support or allow the use of corporal punishment, threats of violence or other forms of mental or physical coercion, and not make use of public warning and punishment systems. Lota and suppliers shall provide workers with channels to appeal and ensure the confidentiality.
  • 10、歧视:公司认可并尊重文化差异。必须保证在雇佣员工时(包括招聘,工资,福利,升职,处分,解雇和退休等)都应只根据员工的工作表现及工作能力而不是以员工的个性作决定。
    Discrimination: Lota and suppliers recognize and respect cultural difference. When determining the recruiting, wages and benefits, promotion and punishment, dismissal and retirement, judge by workers’ job performance and working competence rather than personality.
  • 11、采购:要求所有向路达供货的供应商,遵守在供货合同中有关的禁止转包的承诺。 Purchasing: Suppliers shall comply with the commitment of not subcontracting as in supply agreement.
  • 12、保密性:应保持路达及其客户的委托信息的机密性。必须尊重和保护路达的知识产权,并保持商业机密和其它路达专有信息的机密性,包括任何非公开或不易取得或确定的信息。
    Confidentiality: Lota and suppliers shall keep the confidentiality of client information, commercial secrets and Lota’s proprietary information (including nonpublic, unobtainable, or undeterminable information). Lota’s intellectual property rights are to be respected and protected.
  • 13、监督执行:路达将会独自或在第三方帮助下,采取积极的措施以确保遵守此行为准则,例如对生产设施进行提前告知或突然检查。应保留所有相关文件,以证明其遵守此行为准则,并提供此类文件。
    Supervision and implementation: Lota will take active actions independently or under third party’s support to ensure the implementation of this Code of Conduct, for example, take inspection of production facilities with advance notice or without notice. Relevant documents about the implementation of this Code of Conduct should be recorded and provided on request.
